Jail for man who performed sexual act on another male asleep in bed in Tain
A RESTAURANT worker who went into a man’s bed when he was asleep and performed a sexual act on him, was jailed for a year at Inverness Sheriff Court today.
The offence took place at an address in the Mansfield housing estate in Tain last year.
Twenty two-year-old Mark Mackay, a first offender who now lives in Paisley, admitted at the court sexually assaulting the man on January 4 by entering his bed and placing his victim’s penis in his mouth.
Sheriff Gordon Fleetwood heard both men had been drinking.
Sentence had been deferred for criminal justice social work reports until today.
But in jailing him for 12 months and placing him on the Sex Offenders Register, Sheriff Fleetwood told Mackay: “Basically you took advantage of an intoxicated man to satisfy your own sexual gratification.”
Solicitor Willie Young said Mackay, of Glasgow Road, Paisley, was born in Balintore then moved to Tain in 2014.
He said the victim was known to Mackay and they kept in contact through social media.
“He accepts he encountered him that night. He was heavily under the influence of drink and has no recollection of the incident. He has never suffered black-outs in the past.”
But Mr Young said he was not seeking to deflect blame and accepted the forensic evidence.
“He has never been in trouble before. His knowledge of the offence is it’s extremely serious and the starting point could be custody.”
